Cancellation and Refund Policy

In force from 24 October 2026Siam Luxury Adventure Co., Ltd.

This Policy explains how to cancel or change a Booking, what you get back and when. Cancellation terms on the Card or in your Booking Confirmation come first; the default terms below apply where they set none. It forms part of the User Agreement and binds every Guest.

A summary for convenience. The numbered clauses below are what applies.

1About this Policy

1.1

This Cancellation and Refund Policy (the "Policy") is issued by Siam Luxury Adventure Co., Ltd. (Thai: บริษัท สยาม ลัคชูรี่ แอดเวนเจอร์ จำกัด), a limited company registered in Thailand under the Civil and Commercial Code on 6 July 2023 (B.E. 2566) with the Phuket Provincial Business Registration Office, Department of Business Development, Ministry of Commerce, juristic person registration number 0835566027493, with its registered office at 88/384 Moo 2, Ko Kaeo Sub-district, Mueang Phuket District, Phuket Province, Thailand (the "Company", "we", "us", "our"). It applies between the Company and every Guest and forms part of the User Agreement. Words defined in the User Agreement have the same meaning in this Policy.

1.2

Cancellation terms stated on the Card or in the Booking Confirmation apply first. The default terms in section 3 apply only where neither of them sets cancellation terms for the Service.

1.3

Where Thai law gives the Guest a better right to cancel or to a refund in a particular case, for example the refund rules for tours issued under the Tourism Business and Guide Act B.E. 2551 (2008), that right applies in place of this Policy.

2How to cancel or change a Booking

2.1

A cancellation or a request to change a Booking must be sent to the Company in writing, by email or by the messenger used for the Booking, by the Lead Guest or with the Lead Guest's authority, and must identify the Booking. The contacts are listed in section 9.

2.2

A cancellation takes effect when it reaches the Company, and the Company confirms it in writing. The periods in this Policy are counted back from the start date and time of the Service stated in the Booking Confirmation, in Thailand time.

2.3

A change of dates, times, Service or number of guests depends on availability and on the Supplier's agreement, and any difference in price is paid or refunded. If the Supplier cannot accept the change, the Booking stays as it is unless the Guest cancels it under this Policy.

2.4

If a Booking is moved to new dates at the Guest's request, a later cancellation is assessed against the original start date or the new start date, whichever is earlier.

2.5

A reduction in the number of guests, days or nights is treated as a cancellation of that part of the Booking.

2.6

Each Booking is assessed under its own terms. Cancelling one Service does not cancel other Services of the same trip unless the Guest asks for that.

3Default cancellation terms

These terms apply only where the Card and the Booking Confirmation set no cancellation terms for the Service. Percentages refer to the amounts the Guest has paid for the Service, not including any Security Deposit.

3.1

"Payment costs" are the bank, transfer and currency exchange charges actually incurred on the payment and on its refund. "Amounts the Supplier does not refund" are costs that the Supplier has actually and reasonably committed for the Booking and cannot recover, such as tickets, permits or third-party services already paid for. The Company shows them to the Guest on request.

3.2

"No-show" means that the Guest does not arrive at the agreed place and time, or within the time that the Supplier can reasonably wait, without having cancelled, or arrives in a state in which the Supplier may refuse the Service under the User Agreement.

3.3

The amounts kept reflect that the Service was reserved for the Guest, that other guests were turned away, and that a late cancellation can rarely be filled. They are meant as a fair estimate of the Supplier's loss.

3.4

If the Supplier books the cancelled Service to someone else for the same dates, the Company asks the Supplier to return part of the amount kept and passes on any amount that the Supplier agrees to return.

3.5

Where a Booking covers several Services, the terms of each Service apply to that Service.

4Cancellation by the Supplier or the Company

4.1

If the Supplier or the Company cancels a Booking, or cannot provide the Service as booked, for a reason that is not the Guest's fault, the Guest may choose:

  1. (a)another date or time for the same Service, or a comparable Service, where available; or
  2. (b)a full refund of everything paid for that Service.
4.2

If the Guest chooses a comparable Service with a different price, the difference is paid or refunded as the Company states when offering it.

4.3

If a Booking is cancelled because the Guest broke the User Agreement, gave false information or did not pay on time, the cancellation is treated as a cancellation by the Guest under section 3.

4.4

The Company is not liable for other costs caused by a cancellation, such as flights or hotels that the Guest booked separately, except where the User Agreement makes the Company liable.

5Weather and safety

5.1

Boat and yacht charters, flights, tours and other outdoor Services depend on weather and sea conditions. The captain, the pilot or the Supplier decides, on the day or shortly before, whether a Service can go ahead safely, taking into account forecasts and official warnings, and that decision is final.

5.2

If a Service is cancelled before it starts for weather or safety, the Guest may choose another date or a full refund of what was paid for that Service.

5.3

If a Service goes ahead with a changed route, timing or programme for weather or safety, no refund is due. If it starts but has to be cut short, the Supplier assesses in good faith whether part of the price can be refunded or credited, taking into account the part already provided and the costs already incurred, and the Company passes on any such amount.

5.4

If the Guest decides not to go ahead with a Service that the captain, the pilot or the Supplier considers safe, this is a cancellation by the Guest under section 3.

6No-shows, late arrival and early departure

6.1

A no-show is treated as a cancellation without notice under section 3, unless the Card or the Booking Confirmation states otherwise.

6.2

If the Guest arrives late, the Service still ends at the time booked, and the time lost is not refunded unless the Supplier agrees.

6.3

If the Guest ends a rental or a stay early or does not use part of a Service, the unused part is not refunded, unless the Supplier agrees to a refund, the reason is the fault of the Supplier, or Thai law requires a refund for the unused period, as it may for car and motorcycle rentals where the Guest gives the notice the rental agreement requires.

6.4

If the Guest's flight to Phuket is delayed or cancelled, the Guest should tell the Company as soon as possible. The Company asks the Supplier to adjust the Booking, but the delay does not change the cancellation terms that apply to it.

6.5

If a member of the party cannot take part because of a sudden illness or injury shown by a medical certificate, the Company asks the Supplier to move the Booking to another date or to give a credit. This does not change the cancellation terms that apply to the Booking.

7Refunds

7.1

Refunds are paid within 14 days after the Company confirms the cancellation or, where the Supplier holds the money, within 14 days after the Supplier returns it to the Company. Where a Supplier refunds the Guest directly, the Company follows the refund up with the Supplier until it is made.

7.2

Refunds are made to the original payment method or account. Where that is not possible, the Company agrees another method with the Guest. Transfer costs and exchange differences are borne by the Guest, so the amount received may differ from the amount paid.

7.3

Unless the Booking Confirmation states otherwise or the cancellation is the fault of the Supplier or the Company, the following are not refundable: payment costs; official fees already paid, such as visa or national park fees; and amounts paid to third parties at the Guest's request that they do not return.

7.4

The Company may deduct from a refund any amount that the Guest owes under the same Booking. With the Guest's agreement, a refund may be given as a credit towards a future Booking instead of money.

7.5

The Company refunds amounts that it holds itself. Amounts paid directly to a Supplier are refunded by the Supplier, and the Company helps the Guest to obtain them, as the User Agreement explains.

8Security Deposits

8.1

A Security Deposit is not part of the price and is not subject to the cancellation terms. If a Booking is cancelled before the Service starts, a Security Deposit already paid is returned in full within 14 days.

8.2

After the Service, the Security Deposit is returned less the amounts the Guest owes, normally within 14 days after the end of the Service, or later for the part needed to cover a cost still being established, such as a traffic fine. The deductions and the procedure are set out in the User Agreement.

8.3

Where Thai law sets a shorter period or other rules for returning a deposit for a particular Service, such as car and motorcycle rentals and residential leases that are contract-controlled businesses under the Consumer Protection Act B.E. 2522 (1979), those rules apply.
